Terms of Service

By accessing or using Profitable ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, subscribers, and visitors.

Profitable is a trading journal and discipline-tracking tool designed to help traders log trades, monitor rule compliance, and analyze behavioral patterns. The Service is provided for educational and organizational purposes only.

Profitable is NOT a financial advisory service. It does not provide investment advice, trading recommendations, or financial guidance of any kind. Nothing on this platform constitutes a recommendation to buy, sell, or hold any financial instrument.

Trading financial instruments — including futures, equities, forex, options, and cryptocurrencies — involves substantial risk of loss. Past performance is not indicative of future results. You are solely responsible for all trading decisions you make. Profitable bears no liability for any financial losses incurred as a result of using the Service.

You must be at least 18 years old and have the legal capacity to enter into binding contracts in your jurisdiction to use the Service. By using the Service, you represent that you meet these requirements.

You may sign in using your Google account via OAuth. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

Certain features of the Service require a paid subscription ("Pro Plan"). Subscriptions are billed in advance on a monthly or annual basis. Payment is processed securely through Stripe. You may cancel your subscription at any time through the Stripe Customer Portal accessible from your account settings. Upon cancellation, your access will remain active until the end of the current billing period.

Profitable is a fully digital service. A 3-day free trial is provided before any charge is applied, giving you the opportunity to evaluate the Service. A valid payment method is required at registration; no charge is made until the trial ends.

All sales are final. Once your free trial ends and a subscription charge is processed, no refunds will be issued for any reason, including but not limited to: partial use, dissatisfaction, change of mind, or account deletion. Subscribing constitutes your acknowledgment that you have had full opportunity to evaluate the Service during the trial period.

EU Waiver of Right of Withdrawal — Important Notice for European Users:

In accordance with Article 16(m) of Directive 2011/83/EU on consumer rights, the 14-day right of withdrawal does not apply to digital content not supplied on a tangible medium where performance has begun. By clicking "Subscribe" or "Start Free Trial" and accessing the Service, you explicitly request immediate performance and acknowledge that you lose your right of withdrawal once the Service has been fully performed. You confirm you have read and understood this waiver before subscribing.

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Service; (c) scrape, crawl, or extract data from the Service without written permission; (d) reverse-engineer or attempt to derive the source code of the Service; (e) transmit malicious code or interfere with the integrity of the Service.

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, and software — are owned by Profitable and are protected by applicable intellectual property laws. You may not reproduce or distribute any content from the Service without express written permission.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Profitable is not a financial advisor, broker, or investment service. The Service provides journaling, discipline tracking, and analytical tools for educational purposes only. Nothing within the Service constitutes financial advice, a recommendation to trade, or a solicitation to buy or sell any financial instrument.

You acknowledge and agree that:

• All trading decisions are made solely by you, at your own risk and discretion.
• Trading financial instruments including futures, options, forex, and equities carries a high risk of substantial financial loss, including loss exceeding your initial investment.
• Profitable bears no liability whatsoever for any trading losses, missed profits, or financial damages incurred directly or indirectly through the use of or reliance on the Service.
• Past performance shown in the Service, whether of real trades or simulated scenarios, is not indicative of future results.

To the maximum extent permitted by applicable law, Profitable and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, loss of goodwill, trading losses on real or simulated accounts, business interruption, or any other pecuniary losses arising out of or in connection with your use of or inability to use the Service, even if Profitable has been advised of the possibility of such damages.

In no event shall Profitable's total aggregate liability exceed the amount you paid (if any) for the Service in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

We reserve the right to modify these Terms at any time. We will provide reasonable notice of material changes via email or a notice on the Service. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts.
